Prepare a Will, Urges Administrator General

Fear not death; instead, be ready and prepare a will to ease the burden of managing your estate.” This was the message from Administrator General Kondwani Jawati, featured on Malawi Broadcasting Station (MBC TV) during the Malamulo Akutinji programme from 8:30 am today.

Jawati encouraged Malawians to make wills to ensure that property distribution after death reflects their wishes. He explained that the Department of the Administrator General, established under the Administrator General Act within the Ministry of Justice and Constitutional Affairs, manages estates of public servants who die without a will or where the office is appointed as executor.

Speaking on the programme, Jawati stressed the importance of following proper legal procedures when handling deceased estates. He highlighted that his office operates under key legislation, including the Deceased Estates (Wills, Inheritance and Protection) Act.

“Among other duties, my office obtains Letters of Administration, facilitates dispute mediation among beneficiaries, offers advisory guidance before matters are referred to court, oversees changes of ownership, and manages distribution of benefits such as pensions for deceased public servants,” Jawati explained.

He expressed concern over the widespread mismanagement of assets by relatives of deceased persons who had not left wills. Jawati reminded the public that it is not the responsibility of relatives or traditional leaders to allocate a deceased person’s assets, as the law provides clear guidance on such matters.

“Many people fear death, but instead of fearing it, they should make prior arrangements to avoid disputes that arise when someone dies without a will,” he said.

Through these efforts, the Administrator General’s office promotes orderly and lawful management of deceased estates across Malawi.
